What changed in v10 (Zelda, 28 August 2026): The field is never free, and Section 6 now says what your monthly rate is made of. Until this version these Terms told you that when HDCC coaches you the field for your lessons was included — which read as though the field cost you nothing. It does not. Your monthly rate is made up of a coaching fee and a field-rental amount, and when HDCC coaches you privately that field amount is charged at a reduced rate. Nothing you pay has changed, and no amount in this correction is new. Zelda's words, 28 August 2026: of her own clients, "my tuition fee is R800 per month and R200 Field Rental/levy, as my own clients get field rental discount of 50%"; of group, "they pay R600 for Tuition and R400 for the field rental/levy. This has also not changed"; and of the arrangement where your own coach bills you, "This was same. No change." You still make one payment when HDCC coaches you, and there is still nothing further to pay for the field for those lessons — that part of v9 was right and is kept. Sections 6.1 and 6.2 are the clauses that changed, including the group and private coaching descriptions. Because no amount you pay has moved, Section 7's 30 calendar days' notice is not engaged by this version — there is no price change to give notice of. Canine Conditioning is unchanged and remains a case of its own: conditioning and field rental are two unrelated things, and your conditioning fee neither includes nor implies field time. Section 14 is untouched by this version. This change was made on Zelda's instruction; the wording is ours.

What changed in v9 (Zelda, 26 August 2026): Whether field rental is included now depends on who coaches you, and Section 6 says so. Until this version these Terms told you that field rental was included in every coaching plan, group and private alike. That is true when HDCC coaches you — the field for your lessons is covered by your monthly rate and there is nothing further to pay for it. ↳ REFINED BY v10 (29 August 2026): still true as to the BILL — one payment, nothing further to chase — but the field is a reduced-rate line inside that rate, not free. It was not true if your coach bills you directly. In that arrangement your coach’s fee is for the coaching, and the field for those same lessons is a separate monthly amount payable to HDCC. Both figures are shown to you before you pay, and the amounts themselves are on the service pages and on the payment screen, not in this document. Sections 6.1, 6.2 and 6.5 are the clauses that changed. Canine Conditioning is unchanged and is a case of its own: conditioning and field rental are two unrelated things, and your conditioning fee neither includes nor implies field time. Group Agility and Group Hoopers are unchanged — HDCC coaches those, so the field for those lessons stays included. ↳ THE STRUCK-THROUGH SENTENCE IS SUPERSEDED BY v10 (29 August 2026): group is unchanged in what it COSTS, which is what that sentence was for, but the field for a group lesson is not free — it is a field-rental amount inside your monthly rate, at the standard rate. See the v10 note above and Section 6.2. If a change to what you pay follows from this, Section 7 still owes you 30 calendar days’ notice before it takes effect, and nothing in v9 shortens that. Section 14 is untouched by this version. This change was made on Zelda’s instruction; the wording is ours.

What changed in v8 (Zelda, 17 August 2026): Section 14 now has a second part, covering canine conditioning. This rewrite was made on Zelda's instruction. Section 14.0 — the general intellectual-property clause that was already there — is unchanged, and it still applies to everything HDCC does, including everything that happens on the fields. What is new is 14.1 to 14.8, and it applies only to canine conditioning. 14.1 to 14.4 cover the training content in your conditioning modules: it belongs to HDCC, your fee buys you the right to watch it while your access lasts rather than a copy of it, and downloading, recording, sharing or teaching from it is a breach of these Terms. 14.4 sets out what we can do about it, including removing your access, ending your membership, and taking legal action under the Copyright Act 98 of 1978. 14.5 is new and covers video HDCC records of your conditioning lesson — it belongs to HDCC, you do not get it as of right, it is never shown to another client, and it is never made public unless you and HDCC agree separately and in writing, by email, for that specific footage and that specific use. 14.6 is new and covers video you upload for feedbackyou keep the copyright in your own video, uploading it is not a media release, and we will ask you by email before any public use, which you are completely free to refuse. 14.7 is new: official training videos are the ones named starting with "FFF". 14.8 is new: access to the conditioning material follows the training stage you are at, and your coach links the exercises for you. There is no penalty figure anywhere in this section — nothing in it makes you liable for a fixed sum of money. Nothing you pay has changed and no deadline of yours has changed, but 14.5 to 14.8 are new terms about video and you should read them. The Photo and Media Release in the Privacy Policy is unchanged and still governs photographs and video of you and your dog on the fields and in classes.

What changed in v7 (17 August 2026): Section 6 now describes the prices you are actually charged. Two things in the previous version were wrong, and both were wrong in HDCC's favour, so they are corrected here rather than left to be discovered on an invoice. There is no five-week conditioning rate — Zelda's words are "there is no five week month and four week month, we leave the rate as 1000 rand fixed". The monthly rate is flat, it covers four sessions, and if your session day happens to fall five times in a month the fifth is a bonus you are not charged for. The phase-in date of 1 November 2026 that v5 announced for the higher five-week rate is therefore cancelled; there is no increase, and nothing to give notice of. Field rental is included in every coaching plan, group as well as private — v5 said group coaching excluded it, and that is no longer true. Nothing you owe has gone up. ↳ THE STRUCK-THROUGH HALF IS SUPERSEDED BY v9 (26 August 2026): it holds when HDCC coaches you and does not hold when your coach bills you directly ↳ AND REFINED AGAIN BY v10 (29 August 2026): it never held in the sense of the field being free — for everyone, HDCC-coached or not, the field is an amount inside or beside your monthly rate — see the v9 note above and Section 6.2. The rest of this note still stands. The 30 calendar days' notice promised in Section 7 is unchanged. Your cancellation notice periods have changed for regular weekly slots — 72 hours instead of 24, with sickness still at 24 — and that change is set out in full in the Cancellation and No-Show Policy v5, which moved on the same date as these Terms and is covered by the same acceptance. A one-off booking is unchanged.

What changed in v6 (Zelda, 14 August 2026): Section 7 now promises you 30 calendar days’ notice before we put a subscription price up or make any other material change. This replaces a longer notice window that was counted in business days, and it is Zelda’s own decision — 30 days on an ordinary calendar is easier for everybody to count than a range of working days. Please read this as a shortening: the previous wording gave you more warning than this one does. Nothing else in Section 7 changed — your right to cancel on 20 business days’ notice, and your 30-day penalty-free window to walk away if you do not like a change (Section 13), both stand. No price is changing today. Existing and new conditioning clients stay on the rate they are on now until Zelda decides otherwise, and when she does, this clause is what she owes you.

What changed in v5 (13 August 2026): Section 6 no longer prints individual amounts. The current price list is published on the service pages and is shown to you on the payment screen before you pay — that is now the authoritative list, and it means a price change no longer requires you to re-accept these Terms. Section 6.4 has also been corrected: it previously stated the foundation-course split as R1,050 / R950, which did not match the split actually applied (R1,200 to Elzabi van Wyk, R800 to HDCC) or our other policy documents. Section 6.2 now states plainly that group coaching does not include field rental and private coaching does, and that a 5-week conditioning month covers five sessions at the published 5-week rate. Your cancellation rights and notice periods were unchanged by v5; the material-change notice period itself changed in v6, below.

↳ SUPERSEDED BY v7 (17 August 2026). The struck-through sentence above is left in place because it is an accurate record of what v5 said, and a change history that quietly rewrites itself is worth less than no change history at all. It no longer describes what you pay. Field rental is included in every coaching plan, group as well as private, and there is no five-week rate — see the v7 note above and Section 6.2. ↳ AND THAT CORRECTION WAS ITSELF SUPERSEDED BY v9 (26 August 2026), which is why half of it is struck through in turn: field rental is included when HDCC coaches you and is billed separately when your coach bills you directly. ↳ AND v10 (29 August 2026) CORRECTS THE WORD “included” ITSELF: when HDCC coaches you the field is a reduced-rate amount inside your monthly rate, paid in the same single payment — never nothing. The five-week rate is still gone.

What changed in v4 (Zelda, 12 August 2026): the courses are named Foundation Course 1 and Foundation Course 2 — an earlier renaming has been reverted to Zelda's own names; card is the only payment method HDCC accepts; and one service line was removed because it is not on offer. No price, no deadline and no obligation of yours changed.

PLEASE READ THESE TERMS CAREFULLY. They contain important provisions that limit our liability and require you to indemnify us in certain circumstances. Under the Consumer Protection Act (CPA) section 49, we draw your specific attention to those clauses before you agree to them. The plain-language summary in Section 11 (Indemnity — Plain Summary) explains what you are agreeing to.


1. The Parties

These Terms and Conditions ("Terms") govern your use of facilities and/or services provided by Helderberg Dog Coaching Centre ("HDCC", "we", "us", "our"). HDCC is a trading name operated by Zelda Simon (the "Owner").

These Terms apply to you, the "Client", and any person or dog you bring to our facilities. By engaging with us, you agree to be bound by these Terms, our Rules, our Cancellation and No-Show Policy, our Privacy Policy, our Liability Waiver, and our Photo and Media Release.

2. Definitions

  • Client / Handler: The person registering, booking, paying or using services.
  • Dog: Any canine animal brought to the Site by the Client.
  • Session: A scheduled coaching class, private lesson, conditioning session, or field rental slot.
  • Booking: A reservation made for a Session.
  • Subscription: A recurring monthly payment for an active option — Canine Conditioning and Fitness Coaching (CFT), Agility Private, or Hoopers Private — see Section 6.
  • Field Rental: Per-session hire of a field for a 25-minute self-booked slot, for one dog. Sold as session packages — see Section 6.1.
  • Site: The training facilities at Annandale Drive, Somerset West, on the Seventh Day Adventist School premises.
  • Coach: Zelda Simon, Elzabi van Wyk, Sarah Davies (in her photographer/collaborator capacity), or any authorised instructor acting on Zelda's behalf.
  • Landlord: Seventh Day Adventist School.

3. Acceptance and Electronic Signature

By ticking the acceptance boxes on our registration platform, drawing your signature on the on-screen signature pad, and submitting the form, you acknowledge that you have read, understood, and agreed to these Terms.

Under the Electronic Communications and Transactions Act (ECTA) section 13, an electronic signature that the parties have agreed will be used and that meets the reliability requirements of section 13(3) is legally valid for service contracts of this kind. Your drawn-pad signature, combined with your account email confirmation, constitutes a valid electronic signature for the purpose of accepting these Terms.

4. Services Offered

HDCC provides the following services (current pricing in Section 6):

  • Field Rentals — self-directed 25-minute slots on Agility, Hoopers, or the Spare Field.
  • Canine Conditioning and Fitness Coaching (CFT) — Initial Assessment + ongoing maintenance + group warm-up/cool-down. Delivered in the Canine Conditioning Studio.
  • Agility — group classes and private lessons from Foundations through Advanced.
  • Hoopers — group classes and private lessons from Foundations through Advanced.
  • Event Hostinghalf or full-day hire of HDCC facilities for competitive or non-competitive dog-sport events (KUSA, SADAA, SAWDA and similar disciplines welcome).

5. Site Rules (cross-reference)

Detailed Site Rules — including the Sabbath observance (sunset on a Friday to sunrise on a Sunday), vaccination requirements, conduct expectations, and the presence of Zelda's personal dogs — are set out in our separate Rules document. You must read and tick acceptance of the Rules document as part of registration.

6. Pricing and Subscriptions

All prices are in South African Rand (ZAR). HDCC is not registered for VAT (turnover below the R1m threshold), so all prices are VAT-inclusive only. No VAT-exclusive or VAT-added pricing will appear on any HDCC invoice or page.

Where the current amounts are. The authoritative price list is the one published on the relevant service page and displayed to you on the payment screen before you pay. This Section describes what each option includes and excludes; it deliberately does not reprint the amounts, so that a price change does not silently leave this document contradicting what you are charged. Any material change to a subscription price is notified under Section 7.

6.1 Field Rental Pricing

  • Sold as a package of five sessions, paid up front. The package price is published on the Field Rentals page and shown to you before payment.
  • A session is 25 minutes, self-booked, for one dog, and is self-directed (no coach included).
  • A package balance carries over into a new month once.
  • Every coached lesson carries a field-rental amount. What changes is who you pay it to, and whether it arrives as one payment or two. When HDCC coaches you, your monthly rate is made up of a coaching fee and a field-rental amount for those lessons, at a reduced rate; you pay them together as one payment and there is nothing further to pay for the field for those lessons. When your coach bills you directly for their tuition, the field is not part of what you pay them — it is a separate monthly field-rental amount payable to HDCC, shown to you next to their fee before you pay, and it covers the field for those same lessons.
  • Either way, field time you book for yourself, beyond your coached lessons, is bought as a package under this Section.

6.2 Subscription Options (active)

Monthly coaching options are available. Each is independent of the others — you may hold any combination simultaneously, and the amounts add up.

Every coaching option below is billed at the same flat monthly coaching rate, and that rate covers 4 sessions. If your session day falls five times in a calendar month, the 5th session is included at no extra charge. There is no separate 5-week rate.

What that rate is made up of, and who you pay, depends on who your coach is. If HDCC coaches you, your monthly rate covers both the coaching for those 4 sessions and the field for them, at a reduced field rate — one payment, and nothing else to pay. If your coach bills you directly, you pay them the coaching rate and you pay HDCC a separate monthly amount for the field; both figures are shown to you before you pay, and together they cover the same 4 sessions. Either way the field is part of what you are paying for; it is never given free of charge, and the amounts are on the service pages and the payment screen. Canine Conditioning is a case of its own: conditioning and field rental are two unrelated things, and your conditioning fee neither includes nor implies field time.

Field time you want beyond your coached sessions is bought separately under Section 6.1.

Group coaching — Group Agility and Group Hoopers. Minimum 4 lessons per month. Your monthly rate covers both the tuition and the field rental for those lessons, as one payment, with nothing further to pay for the field.

Private coaching — Agility Private and Hoopers Private. Minimum 4 one-on-one sessions per month. If HDCC coaches you, your monthly rate covers the coaching and the field for those sessions at a reduced field rate, as one payment; if your coach bills you directly, their fee and the monthly field-rental amount you pay HDCC are separate, and both are shown to you before you pay.

  • Canine Conditioning and Fitness Coaching (CFT). Weekly conditioning sessions with Zelda in the Canine Conditioning Studio. The published monthly rate covers 4 sessions and does not change with the length of the month: if your session day falls five times in a calendar month, the 5th session is included at no extra charge. There is no 5-week rate, and nothing about your conditioning price changes on 1 November 2026 — an earlier version of these Terms announced a higher 5-week rate from that date, and it has been withdrawn. A session cancelled within the cancellation policy rules may be made up — any cancelled lesson must be rescheduled within 30 days of the cancellation, after which the make-up right lapses.

    CFT signup is a commitment to an Initial Assessment + three months of conditioning, billed monthly. Three months is the minimum window in which Zelda can demonstrate measurable change on structural and gait measurements; shorter commitments do not serve the Client's investment or HDCC's coaching method. If the Initial Assessment is conducted in month A, the first monthly coaching session begins in month A+1 — this allows Zelda time to complete the gait analysis video and structural assessment that inform the conditioning plan. Cancellation rights under CPA section 14 (20 business days' written notice) apply throughout, subject to a reasonable cancellation charge for any sessions already delivered or scheduled within the notice period.

  • Agility Private. At least 4 one-on-one agility coaching sessions per month. If HDCC coaches you, your monthly rate covers the coaching and the field for those sessions at a reduced field rate, paid together as one payment. If your coach bills you directly, their monthly fee is separate from the monthly field-rental amount you pay HDCC, and both are shown to you before you pay. Make-up right as above.

  • Hoopers Private. At least 4 one-on-one hoopers coaching sessions per month. If HDCC coaches you, your monthly rate covers the coaching and the field for those sessions at a reduced field rate, paid together as one payment. If your coach bills you directly, their monthly fee is separate from the monthly field-rental amount you pay HDCC, and both are shown to you before you pay. Make-up right as above.

6.3 Initial Assessment (CFT)

The first CFT session is an Initial Assessment, billed once off at the published amount (60-90 minutes — gait analysis, structural analysis, and tailored conditioning plan). This is separate from the monthly CFT subscription and is billed once at sign-up.

6.4 Foundation Courses (Hoopers and Agility — separate)

Foundation Course 1 and Foundation Course 2 are offered for Hoopers and for Agility as separate 8-week courses, each at the published course fee, and each includes a warm-up and cool-down session in one of the eight weeks.

The course fee is paid as a split, and the two amounts are shown to you before you pay:

  • R1,200 to Elzabi van Wyk (course tuition fee — deposited into Elzabi's nominated bank account).
  • R800 to HDCC (field and equipment use levy — deposited into HDCC's nominated bank account).

Correction. Versions up to v4 of this document stated this split as R1,050 / R950. That was never the split applied, and it did not match our Cancellation Policy or our Liability Waiver, both of which state R1,200 / R800. The amounts above are the ones that have been charged and paid out. If you believe you were quoted the earlier figures, contact us and we will put it right in your favour.

You will receive two separate payment instructions at booking. Enrolling in a Hoopers foundation course and an Agility foundation course requires two separate course bookings.

6.5 Payment Methods

For anything you pay HDCC, we accept card payments only — EFT is not offered. Where a purchase is split between HDCC and a coach who bills you directly — a foundation course, or a monthly plan where your coach invoices you for the coaching — you pay HDCC’s part by card and you pay your coach’s part by EFT into their own account, using the reference we give you. Both amounts, and who each one goes to, are shown to you before you pay. Your purchase is not complete until both parts have been received. Subscription payments are billed in advance.

Card payments are processed for us by VodaPay (Vodacom). We do not see or store your full card details. If we change payment processor we will say so here.

Where HDCC offers it, you may choose to pay several months in advance by card instead of monthly. Paying in advance costs the same per month as paying monthly — there is no surcharge for it, and no discount for it either.

6.6 Re-registration Discount

Every client re-registers from scratch each season, returning clients included. HDCC may offer a discount on the relevant month's fee to clients who re-register on time. It is offered at HDCC's discretion, is not automatic, and is shown on the payment screen when it applies.

7. Auto-Renewal and Notice (CPA section 14)

YOUR SUBSCRIPTION AUTO-RENEWS.

  • Auto-Renewal: Your monthly Subscription will automatically renew on the first day of each calendar month unless you cancel.
  • Your Right to Cancel: Under the Consumer Protection Act section 14, you may cancel at any time by giving us 20 business days' written notice via email to legal-notices@helderbergdogcoaching.co.za. A reasonable cancellation charge may apply for sessions already delivered or scheduled within the notice period.
  • Material-Change Notice: We will give you at least 30 calendar days’ notice before any material change to your subscription terms or to your subscription price. The 30 days are ordinary calendar days — weekends and public holidays count — and they run from the day we send the notice to the email address on your account. A change takes effect on the first billing date that falls after those 30 days have passed, so you are never re-priced part-way through a month you have already paid for. Section 13 also gives you 30 days from that notice to cancel without penalty if you do not want to accept the change.

8. Cooling-Off for New Online Subscriptions (ECTA section 44)

Because HDCC subscriptions are taken out electronically, the Electronic Communications and Transactions Act section 44 gives you a 7-day cooling-off period to cancel any new subscription without reason.

  • The 7 days run from the day after your subscription begins.
  • To cancel under this clause, email the Information Officer at legal-notices@helderbergdogcoaching.co.za.
  • We will refund the full subscription fee within 30 days, minus the pro-rata cost of any sessions you have already attended within the 7-day window (per ECTA s44(2)(a) — services begun with your consent).

This cooling-off right applies only to new subscriptions and does not affect the per-session cancellation policy in Section 9 below.

9. Cancellation and No-Show Policy (cross-reference)

Detailed session cancellation rules (the notice you owe — 24 hours for a one-off session, 72 hours for a regular weekly slot, 24 hours where the reason is sickness — no-show forfeiture, refund mechanics, admin-discretion bonus sessions, foundation course refund schedule) are set out in our separate Cancellation and No-Show Policy. You must read and tick acceptance of that document as part of registration.

10. Client Obligations

You agree to:

  • Provide accurate information when registering.
  • Disclose any history of aggression, bite incidents, fear reactivity, or medical issues regarding your dog.
  • Keep vaccination records current and available for inspection.
  • Follow all instructions given by the Coach.
  • Ensure your dog is under control at all times.
  • Pay in advance for all services you book.

11. Indemnity — Plain Summary (CPA section 49)

Read this. You are agreeing to take on certain risks.

By accepting these Terms, you agree that:

  1. Dog coaching is an activity with inherent risks. Bites, scratches, falls, and unpredictable behaviour can happen. You accept these risks by participating.
  2. You will pay for damage your dog causes to other dogs, people, or property at the Site.
  3. You will not bring a claim against HDCC, Zelda Simon personally, our Coaches, or the Landlord for losses caused by your own negligence or your dog's behaviour.
  4. You CAN still bring a claim against HDCC for losses caused by HDCC's gross negligence or HDCC's intentional wrongdoing — these are your protected rights under CPA section 51 and cannot be excluded.

The detailed indemnity language is in our separate Liability Waiver and Indemnity document, which you will read and sign separately.

12. Limitation of Liability (CPA section 48)

To the extent permitted by South African law and excluding the protected categories in Section 11.4 above:

  • HDCC's total liability to you for any claim arising from these Terms is capped at the total fees you have paid to HDCC in the 12 months preceding the claim. We do not believe this cap is unfair under CPA section 48 because it is proportionate to the value of the services rendered.
  • HDCC excludes liability for indirect, consequential, or special damages.
  • This cap and these exclusions do NOT apply to liabilities that cannot be excluded by law, including HDCC's own gross negligence (CPA section 51).

13. Policy Changes — Instant Notification

When we change any of the following documents — these Terms, the Rules, the Cancellation Policy, the Privacy Policy, the Liability Waiver, or the Photo and Media Release — we will:

  1. Send an email immediately from legal-notices@helderbergdogcoaching.co.za (a no-reply address used only for legal notices) to every registered handler with a link to the updated document and a short summary of what changed.
  2. Show an updated "Effective Date" and "Document ID" at the top of the changed document.
  3. Honor a 30-day grace period during which you can cancel any subscription without penalty if you disagree with the change.

You should add legal-notices@helderbergdogcoaching.co.za and helderbergdogcoachingcentre@gmail.com to your safe-sender list. If you do not receive a change-notification email, please check your spam or promotions folder and mark our sender as safe.

14. Intellectual Property

This section is in two parts, and neither part replaces the other.

14.0 is the general clause. It applies to everything HDCC does, including everything that happens on the fields.

14.1 to 14.8 apply to the canine conditioning training content and to video of your canine conditioning lessons. They add to 14.0. They do not replace it, and nothing in them narrows it.

If you are not on a canine conditioning programme, 14.0 is the part that applies to you. If you are, both parts apply.

14.0 All HDCC services, including everything on the fields

HDCC retains all intellectual property rights in our curriculum, training materials, website content, and video footage. For rights regarding photos or videos of you and your dog, please refer to our separate Photo and Media Release.

14.1 to 14.8 — Videos, Photos, and Who Owns Them AS IT RELATES TO CANINE CONDITIONING

14.1 What this section covers

There are three different kinds of footage at HDCC and they are not treated the same way. This section deals with each one separately, because mixing them up is how people end up surprised.

  1. Training content — the teaching videos and photos of Zelda's own dogs that you watch in your conditioning modules.
  2. Lesson footage for records — video a coach takes of you and your dog during a lesson or an assessment.
  3. Video you upload — footage you send in yourself so that your coach can look at it and give you feedback.

14.2 HDCC training content — HDCC's, and yours to watch only

All the training videos, photos, written notes and exercise material in your modules belong to Helderberg Dog Coaching Centre. They were made, using Zelda’s own dogs, and HDCC keeps the copyright in all of it.

When you pay for a programme that includes this content, you are buying the right to watch it, for as long as your access lasts. You are not buying the content, and you do not get any ownership of it. Your permission to watch is personal to you — it is for you and the dog or dogs registered on your account for canine conditioning specifically, and it is not transferable.

What you may not do with it. You agree that you will not:

  • Download it, rip it, or save a copy of any video, in any way.
  • Screen-record it, screenshot it, or film the screen with a phone or any other camera.
  • Share it with anyone who is not a paying HDCC client — that includes sending it to a friend, posting it in a WhatsApp group, uploading it to social media, or putting it on any other website or platform.
  • Share your login or let someone else watch through your account.
  • Copy the content into your own material, or teach from it, or use any part of it in your own classes, workshops, courses or business — paid or free.
  • Change it, edit it, translate it, or re-caption it, or strip out any watermark, credit or name on it.
  • Claim it as your own, or register any copyright, trade mark or other right in it.

14.3 What we do to protect it, and what we cannot do:

What we do: training content is behind a login, released to you a step at a time by your coach, and the page does not offer a download. We do not publish direct file links, and we may watermark video with your name.

14.4 If you break this

If you copy, download, record or share any HDCC training content in breach of section 14.2, then:

  • We will remove your access to the training content immediately, without a refund of the portion of your fee that relates to it.
  • We will end your HDCC membership under Section 16 of these Terms.
  • We will require you to delete every copy you have made and to declare to whom you gave it to.
  • We can take legal action. Copyright infringement is a civil wrong and, where it is done commercially, an offence under South African Copyright Act 98 of 1978 and section 27. This section carries on applying after you leave HDCC. Cancelling does not release you from it.

14.5 Footage recorded of your lesson — it belongs to HDCC, and it stays private.

When a HDCC coach records your lesson, your assessment, or your dog's gait analysis:

  • That footage belongs to HDCC. We filmed it, and own the copyright in it.
  • It is raw working material. It is not edited, it is not finished, and it is filmed for one purpose: so that your coach can study your dog's movement and coach you accordingly.
  • It is not part of what you bought. Your fee pays for the coaching and for the feedback you are given from that footage. It does not buy you the footage.
  • You do not get access to it as of right, and you do not get an archive of your old lessons. HDCC decides, in each case, whether a clip is useful to release to you. When we choose to release something to you, it appears in your own account and is visible only to you. When we do not, it stays with HDCC.
  • It is never shown to another client. We do not show your dog to somebody else's handler.
  • It is never made public. Not on the website, not on Facebook or Instagram, not in an advert, not in a flyer, not at a talk. Not unless you and HDCC have agreed to it separately and in writing, by email, for that specific footage in your canine conditioning session, and that specific use.

If you want something public, that is a separate conversation. Any public or marketing use of footage of you or your dog is arranged case by case, in writing, by email, and is handled through our marketing team. There is no blanket permission, and nothing in your canine conditioning registration gives us one.


14.6 Video you upload for feedback — you are asking for coaching, nothing else

When you upload a video of your dog for your coach to look at, you are giving her permission to do one thing: to watch it, study it, and answer you.

That specifically means she may:

  • Watch it, as many times as she needs to.
  • Take screenshots from it and mark them up with arrows, circles and notes.
  • Write you feedback about it, and send that feedback back to you.
  • Keep it on file as part of your dog's record, so that progress can be compared over time.

And that is the whole of it. Uploading a video is not a media release. It is not permission to publish it, to advertise with it, to put it on the website or on social media, to show it in a class, or to use it as a teaching example. If we ever want to do any of those things, we will ask you, by email, for that specific video — and you are completely free to say no. Saying no changes nothing about your coaching, your bookings or your standing at HDCC.

Your video is never shown to another client. Not to a class, not to a training group, not to another handler. Your dog's work is between you and your coach

You keep the copyright in your own video — it is your footage. What you are giving HDCC is a narrow permission to use it for coaching you, and nothing wider.

One thing we ask of you: only upload footage you are entitled to upload. If a friend or a professional filmed it, make sure they are happy for you to send it in. And if another person's face is in it, please make sure they do not mind.


14.7 Which videos are the training content

HDCC’s official training content is the material published in your modules on this website. Training videos are named starting with "FFF". If it does not start with FFF, it is not HDCC training content — it is either working footage, something Zelda sent you personally, or something else entirely, and it does not carry a licence to be treated as course material.

14.8 How long your access lasts

Access to the conditioning training content is based on the training stage you are at.

Where video footage is available of specific exercises, your coach will link them for you, to provide additional assistance, as you work through them together in your sessions. That is deliberate: it is a dog safety decision, not an admin one. If you are not linked to any exercises during your registration, and you were previously linked on it, and you want to review a section again, you are welcome to ask us.

Access ending does not end section 14.2. What you were shown while you had access stays HDCC's, and the restrictions carry on applying.

15. Force Majeure and Field-Closure Discretion

We are not liable for failure to perform due to events beyond our reasonable control, including load-shedding, extreme weather, weather whose aftermath renders the field surface unsafe (e.g. slippery turf following heavy rain), pandemics or government lockdowns, closures imposed by the Landlord, and acts of God.

HDCC reserves sole discretion to close the Site, suspend sessions, or modify session arrangements where Zelda or any authorised Coach determines that safety, weather, surface conditions, or operational requirements require it. Decisions to close or modify under this clause are made in good faith on safety and operational grounds and are not subject to challenge under this Section.

16. Suspension and Termination

HDCC reserves the right, at our sole discretion, to suspend or terminate your access immediately if you breach safety rules, fail to make payment, repeatedly violate Site Rules, or if your dog poses a safety risk to others.

17. Dispute Resolution

We prefer to resolve disputes amicably.

  1. Negotiation: We will attempt to resolve the dispute in good faith within 14 days.
  2. Mediation: If negotiation fails, we will attempt mediation.
  3. Arbitration: If mediation fails, the dispute will be referred to arbitration under the AFSA Rules.
  4. Statutory rights: Nothing in these Terms prevents you from approaching the National Consumer Commission, a provincial consumer court, or the Information Regulator regarding your statutory rights.

18. Severability, Notices, Waiver

  • Severability: If any part of these Terms is found invalid (e.g. unfair under CPA section 48), the remaining terms remain in full force.
  • Notices: Email to the address you registered with.
  • Waiver: Our failure to enforce a right does not constitute a waiver of that right.

19. Governing Law and Jurisdiction

These Terms are governed by the laws of the Republic of South Africa. You submit to the exclusive jurisdiction of the High Court of South Africa, Western Cape Division.
